CONSULTATION AGREEMENT
This document contains the entire agreement between Mr./Ms._______________________________________________________ of (LEO) ___________________________________________ and Mr. David Todeschini of Net 4 Truth USA Ministries. No other agreement is in force, and no other documents may be represented to be a part of this agreement unless attested to in writing by both parties, and verified by a licensed Notary Public. To wit:
Mr. David Todeschini agrees to the following:
Mr. David Todeschini represents to the client, that he is duly qualified by virtue of over 30 years experience in the computer field, to examine the contents of personal computers, for the purpose of determining whether or not said machines are or were being used in the commission of a crime, or illegal activity. Mr. Todeschini will, upon agreement to the terms set forth herein, examine and verify the contents of suspect machines, providing a detailed report and evidence of contents to the investigating officer or agency. This evidence can consist of video tape of the entire examination procedure, and a CD-ROM copy of all suspect material retrieved from the machine in question.
In the case of encrypted files, the examination procedure may also involve sending a copy of the encrypted file to the manufacturer of the software which created the file for password retrieval, or in the alternative, obtaining and using an appropriate software utility to decrypt the file to see if the contents are incriminating. Due to the nature of the investigative process, there is no assurance that anything incriminating will be found. However, the use of specialized software and proprietary software tools will uncover most illicit activity. In the case of Internet crimes, Mr. Todeschini will, on behalf of the LEO, coordinate efforts between the LEO, the Internet Service Provider (ISP), and the prosecuting attorney (DA), to facilitate traces ("footprints") and activity logging of the suspect is performed correctly, and in a manner that will not destroy its admissibility as evidence in court.
Any information or data which is collected will be considered and held SACROSANCT by Mr. Todeschini, and not revealed to anyone, under any circumstances.
The contracting investigator or agency / LEO agrees to the following:
The LEO/Investigator will give Mr. Todeschini access to any and all pertinent case information, whether or not it is directly or indirectly related to retrieval of information from a suspect's computer. Often this information provides valuable clues as to what to look for and where, saving valuable time.
In the case of Internet abductions or "Net-Napping", the LEO/Investigator will allow Mr. Todeschini to interview any witnesses, or anyone who may have information.
A consultation fee of $100 per hour based on time of initial contact. This may be adjusted downward by actual time spent working on the case. In the event that specialized software is required for the extraction of the passwords of encrypted files, the LEO agrees to absorb the cost of the software. This requirement is necessary, since it is prohibitive for any investigator to have on hand, decryption software for every software product (and every version thereof) on the market. This is handled on a case-by-case basis as it is encountered.
If travel to and from a site and / or overnight lodging is required, the LEO will be responsible for actual and reasonable expenses incurred while the investigation is in progress.
THIS DOCUMENT CONTAINS THE ENTIRE AGREEMENT, AND MAY NOT BE AMENDED WITHOUT THE WRITTEN, NOTARIZED CONSENT OF BOTH PARTIES.
